Supreme Court upholds ACA Subsidies
Thursday, June 25, 2015 The U.S. Supreme Court issued a decision this morning upholding the payment of the ACA subsidies to consumers who obtain coverage through the federal Exchange. The 6-3 decision in King v. Burwell means that tax credits continue to be valid in the 34 FFM states, including Texas. The Court’s decision upholding the subsidies cannot be reversed by regulation. According to analysts, removal of the ACA tax credits would have resulted in an exodus of young and healthy individuals from the insurance market, leaving an insurance pool made up almost exclusively of the elderly and the sick. An adverse ruling for the subsides would have jeopardized access to the health insurance market for over 800,000 Texans—the second largest impacted population in the country—causing their premiums to spike on average by 305 percent, according to Kaiser Family Foundation. Now that the Court has made its ruling, FirstCare Health Plans is focusing our attention on what matters most—ensuring our members’ access to affordable coverage and high-quality health care in the communities we serve.
